Selecting a Neutral

In choosing a mediator or arbitrator, parties should consider what kind of background is most suitable for their dispute. It is important to note, by design, IDRS's panel of arbitrators/mediators are independent contractors and are not employees of IDRS. This eliminates any possibility of business conflicts, thus affording parties the most neutral, independent, impartial, and confidential forum available.

Whenever IDRS or its panel act as a neutral in a dispute among parties, all known potential conflicts of interest are disclosed to all parties. No mediator/arbitrator shall serve in any dispute in which there is a conflict of interest, unless there is full disclosure and agreement by all parties. Prior to accepting an appointment, the prospective mediator/arbitrator shall disclose any circumstances likely to create a presumption of bias or interest in the outcome of the proceedings, or prevent a prompt meeting with the parties.

 

When appropriate, IDRS will include experts and specialists on an arbitration/mediation panel or consult them as expert witnesses.
